eGift Cards Terms and Conditions

  • 1. compliance with laws

    By purchasing a gift card ("eGift Card") offered by D.T.S.M., you are certifying and representing to D.T.S.M. that the activities in connection with which the eGift Card will be used will comply with these eGift Card Terms and Conditions, all applicable laws, rules and regulations and that the eGift Card will not be used in any manner that is misleading, deceptive, unfair or otherwise harmful to guests. In addition, you agree to defend, indemnify and hold harmless D.T.S.M., its parent, subsidiaries, affiliates and their respective directors, officers, employees, agents, service providers, contractors, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your purchase or use of eGift Cards or your breach of these eGift Card Terms and Conditions.

  • 2. type of gift cards

    EGift Cards are electronic gift cards that are emailed to recipients and can only be purchased and redeemed online. EGift Cards can be purchased at www.d-t-s-m-driving-school.myshopify.com, and will be emailed within two hours of purchase.

    EGift Cards can be purchased in the following denominations: $50 CAD, $100 CAD, $150 CAD, $200 CAD and $250 CAD.

    We do not charge sales tax on the purchase of eGift Cards; however, applicable sales tax (HST) will be charged on all products/services paid for with an eGift Card.

  • 3. payment methods

    EGift Cards may be purchased with a valid Visa, MasterCard, American Express Card, Discover Card, Diners Club Card or by e-transfer to dtsmdrivingschools@gmail.com.

  • 4. redemption

    Redeeming your eGift Card is easy. Simply:

    1. Shop online at https://d-t-s-m-driving-school.myshopify.com and select the item(s) you wish to purchase;
    2. When you are ready to checkout, click on your Cart;
    3. You will then be prompted to create a customer profile or to sign in to your existing customer profile. Once you have signed in or created a profile, proceed to the Checkout;
    4. At the bottom or right hand side (depending on the device you are using) of the payment page at the final step of your Checkout, enter your eGift Card Code (16-digit code found on the front of your eGift Card as shown in the image below) in the field labeled “Gift Card or discount code”; and
    5. Click “Apply” and you will see your eGift Card amount deducted from your order total.

    You can use multiple D.T.S.M. eGift Cards to pay for your order. Any balance remaining after paying your order total will remain on the eGift Card for future use. If an amount is still owing after your eGift Card has been used, select another payment method to complete the order.

  • 5. balance inquires

    To obtain your eGift Card balance, email us at dtsm@dtsm.ca and the balance will be sent to the original eGift Card recipient by email within two business days.

  • 6. validity

    The maximum value of an eGift Card upon purchase is $250 CAD, and the minimum value is $50 CAD. If the balance of your eGift Card is $0 CAD, the eGift Card is invalid and cannot be re-activated or used again.

  • 7. expiration

    EGift Cards do not expire or decrease in value if unused and we do not assess any service fees for non-use.

  • 8. risk of loss

    EGift Cards cannot be refunded, re-sold, transferred for value, redeemed for cash, are not negotiable instruments and cannot be replaced if lost, stolen, destroyed or used without your permission. The risk of loss and title for eGift Cards passes to the purchaser upon our electronic transmission to the recipient. D.T.S.M. is not responsible for lost or stolen eGift Cards. We cannot trace them or refund them.

  • 9. reasons for failed delivery

    If you have purchased an eGift Card online, but the recipient has not received it, ask the recipient to check their junk mail or deleted items email folders. If the recipient still has not received the eGift Card, contact us with your name, your order number and the recipient's email address. Once we have confirmed that the original eGift Card has not been redeemed, we will cancel the original eGift Card and issue a replacement. Some common reasons for failed delivery of eGift Cards include the following:

    1. The recipient’s spam filter blocked the email or routed the email to a bulk/spam folder;
    2. The recipient’s firewall blocked the email;
    3. The recipient’s email inbox is full; or
    4. The email provided for the recipient is invalid.

    If the recipient's spam filter is blocking dtsm@dtsm.ca emails from being delivered, the recipient's email options will need to be modified so that dtsm@dtsm.ca emails are not considered spam.

  • 10. returns

    EGift Cards cannot be returned or cancelled after purchase.

    If you paid for your order using both an eGift Card and a credit card (or other method of payment), we will first issue your refund to your credit card (or other method of payment). If the value of the product/services you returned exceed the amount paid with the credit card (or other method of payment), the balance will be refunded in the form of an eGift Card.

  • 11. our policies

    EGift Cards are subject our Privacy Policy and general Terms and Conditions.

  • 12. fraud

    D.T.S.M. reserves the right to hold an order for security review. If your order is affected, you will be notified via email within two business days. D.T.S.M. reserves the right to close customer accounts, cancel orders and/or request alternative forms of payment if a fraudulently obtained eGift Card is redeemed and/or used to make purchases on the www.d-t-s-m-driving-school.myshopify.com website. D.T.S.M. reserves the right to cancel an eGift Card associated with an unauthorized transaction at any time.

  • 13. not for promotional use

    EGift Cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities (including, without limitation, marketing via Web sites, Internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements and radio and television broadcasts.)

  • 14. limitation of liability

    D.T.S.M. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO EGIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT AN EGIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH EGIFT CARD CODE. CERTAIN LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.

  • 15. disputes

    Any action or proceeding arising out of or relating to our eGift Cards and under these eGift Card Terms and Conditions will be instituted in the courts of the province of Ontario and/or the Federal Court of Canada, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such action or proceeding. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts.

  • 16. general terms

    When you purchase, receive or redeem an eGift Card, you agree that the laws of the province of Ontario and the federal laws of Canada, without regard to principles of conflict of laws, will govern these eGift Card Terms and Conditions. D.T.S.M. reserves the right to change these eGift Card Terms and Conditions from time to time in its discretion. All Terms and Conditions are applicable to the extent permitted by law.
